Luby's sees FY2012 profit at top of range

HOUSTON (AP) ? Luby's Inc. said Thursday that it expects its earnings per share for its just-completed fiscal year 2012 to be on the higher end of its previous guidance as a result of solid sales and the company's ability to control costs.

The Houston-based company, which owns Luby's Cafeteria, Fuddruckers, Koo Koo Roo Chicken Bistro's and Bob Luby's Seafood Grill brands, said it expects earnings to be on the upper end of the guidance of 18 cents to 21 cents per share.

Luby's, which also runs a food service management business, said it expects to report restaurant sales of $324 million for its fiscal year that ended Wednesday. That is also at the top end of its previous guidance. Sales at restaurants open at least a year are expected to rise 2.3 percent, above its guidance of 1.5 percent to 2 percent.

For fiscal 2013, it expects to earn 27 cents to 30 cents per share on stronger sales and better margins. The company expects to open one or two cafes in the year, as well as three to five Fuddruckers.

Shares of Luby's were up 20 cents, or 3 percent, at $6.51 in afternoon trading.

Sacramento, Calif., Mayor Kevin Johnson is fighting to keep his NBA team from leaving town, and there are some Louisvillians who would like to see it move here.

Johnson, a former NBA star, jokingly told about 1,000 people at today?s 2012 Leadership Louisville Luncheon: ?Don?t take my team.?

On a more serious note, Johnson said that if Louisville really wants an NBA franchise, then it needs to make sure it?s prepared.

He said the city already has taken a big step by building the KFC Yum! Center.

A deal to build a new arena for the Sacramento Kings in Johnson?s city fell apart when the team?s out-of-town ownership walked away from the agreement. The owners currently are considering a proposal to move the franchise to Virginia Beach, Va.

If you want an NBA team, you?ve got to be ?poised and positioned,? Johnson told the crowd. ?Do what you can do now.?

Louisville Mayor Greg Fischer, who recently floated the idea of revisiting the recruitment of an NBA franchise to the city, said there aren?t any current talks going on with any professional teams.

But he echoed Johnson?s opinion that the city needs to be ready.

?We have some issues, obviously,? Fischer said, speaking specifically about the University of Louisville?s restrictive lease agreement at the Yum Center.

?We?ve got to be positioned to win.?

Wall Street opens slightly higher after GDP report

Stocks opened with slight gains on Wednesday, in a third day of likely limited action as investors shrugged off the latest data and looked ahead to Federal Reserve Chairman Ben Bernanke's speech on Friday for trading incentives.

Daily volume so far this week has been low even for a seasonally slow period, with trading levels about 30 percent below the year-to-date average, an indication of how market participants are reluctant to make any major investment moves ahead of the Fed speech.

Gross domestic product grew 1.7 percent in the second quarter, a rate that was expected though revised up from last month's 1.5 percent estimate. Futures were little impacted by the data.

Bernanke addresses a conference of central bankers in Jackson Hole, Wyoming, on Friday, and could announce new measures to boost growth. He is expected to stoke expectations for a third round of quantitative easing, though he may not detail the timing of such a measure.

In the absence of clarity on those issues, analysts expect light trading to continue. The S&P dipped over the past two sessions, but the decline was less than 0.1 percent on both days. It hasn't closed with a 1 percent move in either direction since August 3.

"Investors have squared their positions and are taking no risk; it's a bit of a snooze fest until Bernanke," said Chris Bertelsen, chief investment officer of Global Financial Private Capital in Sarasota, Florida.

The S&P 500 has been pinned in a fairly tight range over the last three weeks, finding support at 1,400 while also unable to convincingly pierce the April high of 1,422.38, which has acted as a resistance point. The index has been unable to muster a move of at least 1 percent in either direction since August 3.

In company news, a U.S. judge set a December 6 court date to hear Apple Inc's request for a permanent injunction against Samsung Electronics' smartphones, which could delay the potential impact of Apple's crushing legal victory.

"Whenever this gets resolved, royalties could mean another huge revenue stream for Apple," said Bertelsen, who helps oversee $1.5 billion in assets.

WellPoint Inc Chief Executive Angela Braly abruptly stepped down late Tuesday following growing investor dissatisfaction with the health insurer's financial performance. Shares rose 4.5 percent to $60 in premarket trading.

H.J. Heinz Co rose 1.3 percent to $58.17 in light premarket trading after reporting its first-quarter results and said it was on track to meet its full-year forecast.

Joy Global Inc fell 1.5 percent to $52.29 before the bell after cutting its profit outlook for a second time this year, citing slowing growth in Asia and Europe.

U.S. stocks ended little changed Tuesday after mixed economic data on consumer confidence and home prices gave investors little reason to shift their focus from Bernanke's upcoming speech.

AEP launches $10M ad campaign encouraging energy conservation

American Electric Power Company Inc. has been promoting smart-meter technology with its mobile GridSmart Demonstration Project.?

American Electric Power Company Inc. (NYSE:AEP) plans to spend nearly $10 million over the next three years on an advertising campaign aimed at getting its customers in Ohio to cut their energy use.

That may sound counterintuitive for a company whose profits are driven in part by electricity sales, but that is the reality for power companies in Ohio because of energy efficiency standards approved by state legislators in 2008.

The new campaign, dubbed ?Energy is Precious. Let?s Not Waste It,? features advertising in the all the markets served by AEP Ohio, including Columbus, said spokeswoman Terri Flora. The ads have started running in newspapers and magazines and appearing on television, radio, billboards and digital media.

Created by Engauge Columbus, the ads talk about wasted energy in what an AEP release describes as ?humorous style.? They feature icons that show wasted energy in everyday scenarios.

?We continue to try find ways to educate customers about energy efficiency programs to help them save money,? Flora told me.

She said AEP Ohio?s appliance rebate program will be at the center of the advertising campaign. It provides rebates to customers for buying Energy Star-certified clothes washers, refrigerators, freezers, dehumidifiers and compact fluorescent light bulbs. The company also is continuing to pay customers for having their old, inefficient refrigerators or freezers picked up and recycled.

Ohio utility regulators allow AEP to recover the cost of educational and outreach efforts on its energy efficiency programs through a rider on customers? bills. It works out to less than $2 a month for an average residential customer, Flora said.

Also as part of the ?Energy is Precious? effort, AEP has developed a mobile interactive exhibit in conjunction with Event Marketing Strategies. The custom coach and has been making the rounds at county fairs and other events this summer, showing off ways for consumers to save money by conserving energy. It?s scheduled to make stops at the Columbus Italian Festival from Oct. 5-7 and the Circleville Pumpkin Festival Oct. 17-20.

AEP also has a custom coach to promote smart-meter technology with a mobile GridSmart Demonstration Project.

Relief as Typhoon Tembin skirts Taiwan

Taiwan's rain-battered south heaved a sigh of relief Tuesday after Typhoon Tembin skirted past the island before dawn without making landfall, apparently leaving little damage.

Communities in the exposed southern part of Taiwan had been bracing for a rare second onslaught after Tembin swept across the island late last week and unleashed the worst downpour in more than a century in some areas.

"I feel relieved now," said Yeh Ming-shun, head of Hengchun township, which forms the southernmost tip of Taiwan.

Tembin brushed by Taiwan at 2:00 am (1800 GMT Monday), missing the south of the island by 10 kilometres (six miles), the Central Weather Bureau said.

Hengchun, at the heart of Taiwan's Riviera, is normally a bustling city full of tourists, but Tuesday morning it was deserted, as almost all visitors had cancelled their hotel bookings.

Material damage appeared to be limited, and the area's farmers seemed to have escaped a devastating blow to their livelihoods, partly because they had already harvested a significant amount of the season's fruit and rice.

As of 0115 GMT, Tembin was 130 kilometres (80 miles) north-northeast of Orchid Island off the east coast of Taiwan, according to the Central Weather Bureau.

With a radius of 180 kilometres, the typhoon was packing gusts of up to 119 kilometres per hour and moving northeast at a speed of 22 kilometres per hour.

A second landfall by Tembin would have been a rare event. The weather bureau said Taiwan had been hit by the same typhoon twice only four times since 1977. The last typhoon to do so was Typhoon Nali in 2001.

When Tembin ground its way across Taiwan late last week, it triggered massive precipitation in some places, with Hengchun receiving more than 600 millimetres (24 inches) of rain within a 24-hour span.

If there?s an inherent bias in blogging, it?s that the blogger and their audience, are necessarily in a place that has a steady internet connection. Don?t got an internet connection? You?re way less likely to blog, read a blog, comment on a blog, or get into the ideas that regularly sweep the internet. The internet idea that?s probably most relevant to this particular news item?

That the world is ready for streaming, a la carte television to become the default way that folks get their cable subscriptions delivered to them.

This week the FCC released their eigth?Broadband Progress Report, on the state of broadband internet service in the U.S., and they?ve collected some pretty interesting info. While broadband internet is available in 96% of American households, only 60% of Americans actually subscribe to the service. And of those 60%, only a minority of them actually get download speeds as high as 4 megabits per second, the minimum required speed for actual broadband as defined by the FCC. Most households are getting along with 768 kilobits a second. It?s hard to say whether this is because of subscriber preference, or because, well, many cable companies don?t exactly work very hard to guarantee that the speed they advertise is the speed you get.

As Livescience points out, the bare minimum download speed for Netflix videos is 500 kbps, and that?s for particularly poor quality video. Now, I can?t wait for the day when I can sign up for a television service that allows a la carte purchases of shows rather than bundles of channels, but at the same time, I couldn?t fault Netflix for their price increase when literally every company they need to deal with to remain solvent would rather they be out of business. If streaming internet video is simply not an option for the majority of Americans, the day of streaming access to popular television on a show by show basis may be further off than we?d like, and there may be some hurdles in the way that have nothing to do with big?entertainment?companies concerns over piracy or ad revenue.

Targeted oxidation-blocker prevents secondary damage after traumatic brain injury

Treatment with an agent that blocks the oxidation of an important component of the mitochondrial membrane prevented the secondary damage of severe traumatic brain injury and preserved function that would otherwise have been impaired, according to a research team from the University of Pittsburgh School of Medicine, Graduate School of Public Health and Department of Chemistry in a report published online today in Nature Neuroscience.

Annually, an estimated 1.7 million Americans sustain a traumatic brain injury (TBI) due to traffic accidents, falls, assaults and sports participation, said the study's senior author H?lya Bay?r, M.D., associate professor, Department of Critical Care Medicine, University of Pittsburgh School of Medicine. She added that 52,000 of those injured die, and 85,000 are left with significant disability.

"We don't yet have a specific therapy for TBI, but can provide only supportive care to try to ease symptoms," Dr. Bay?r said. "Our study drug shows promise as a neuroprotective agent that might help address this important public health problem."

For the study, the research team conducted a global assessment of all the phospholipids in rat brain cells. This revealed that damage from TBI was nonrandom and mostly involved cardiolipin, a phospholipid that is found in the membranes that form mitochondria, the cell's powerhouse. They noted that in the healthy animal, only 10 of the 190 cardiolipin species were modified by oxygen, but after a brain injury, the number of oxidized species rose many-fold.

The researchers then developed an agent, called XJB-5-131, which can cross the blood-brain barrier and prevent the oxidation of cardiolipin. Using an established research model of severe TBI, the agent or a placebo was injected into the bloodstream of rats five minutes and again 24 hours after head injury.

In the weeks that followed, treated animals performed akin to normal on tests of balance, agility and motor coordination, learning, and object recognition, while placebo-treated animals showed significant impairment. The results indicate that blocking cardiolipin oxidation by XJB-5-131 protected the brain from cell death.

"The primary head injury might not be that serious," Dr. Bay?r noted. "But that initial injury can set into motion secondary cellular and molecular events that cause more damage to the brain and that ultimately determine the outcome for the patient."

She added that a targeted oxidation-blocker might also be beneficial in the treatment of other neurological disorders, such as Parkinson's disease, amyotrophic lateral sclerosis, or ALS, and stroke.

KEY WEST, Fla. (AP) ? A meteorologist at the National Hurricane Center says Tropical Storm Isaac, which is expected at or near hurricane-strength once it reaches the Florida Keys later Sunday, could become a category 2 hurricane in coming days as it takes eventual aim at the northern Gulf Coast.

Meteorologist Jessica Schauer says the center is currently forecasting Isaac would make landfall late Tuesday night or early Wednesday morning somewhere on the northern Gulf Coast. A category 2 hurricane has winds of 96-110 mph (154-177 kph), but Schauer cautions forecasts that far out in time are subject to greater uncertainty.

Earlier Sunday, the center issued a hurricane watch from the mouth of the Mississippi River ? not including the New Orleans metro area ? eastward to Indian Pass., Fla.

PARAGUANA/CARACAS, Venezuela, Aug 25 (Reuters) - An explosion tore through Venezuela's biggest refinery on Saturday, killing at least 39 people, wounding dozens and halting operations at the facility in the worst accident to hit the OPEC nation's oil industry.
Energy Minister Rafael Ramirez told Reuters no production units at the Amuay refinery were affected and that there were no plans to halt exports, a sign that the incident will likely have little impact on fuel prices.
Photographs taken shortly after the pre-dawn blast showed wrecked vehicles, flattened fences and giant storage tanks buckling and crumpling as flames lit the night sky. A National Guard building in the area was shattered and officials said a 10-year-old child was among the dead.
A gas leak caused the explosion and most of those killed were National Guard troops who were providing security for the 645,000 barrel-per-day (bpd) facility, Ramirez said, adding that the fire was under control.

"There was a National Guard barracks near the explosion. ... The installation was too close to the operations," Ramirez told Reuters in an exclusive telephone interview, adding that production could resume at Amuay within two days at most.
"We need to boost production at other refineries and look for floating storage near the complex," he said.
The incident follows repeated accidents and outages during the last decade across installations run by state oil company PDVSA that have limited output and crimped expansion plans.
Amuay has partially shut operations at least twice this year due to a small fire and the failure of a cooling unit.
Those problems have spurred accusations of inept management by the government of President Hugo Chavez, who is running for re-election on Oct. 7.
Acrimony over the explosion could spill over into an already bitter campaign, but s unlikely to overtake larger political concerns such as crime and the economy.
"I want to convey the deepest pain that I've felt in my heart and soul since I started to get information about this tragedy," Chavez said in phone call to state TV. He declared three days of mourning.

FIRE UNDER CONTROL
Venezuela has traditionally been a big supplier of fuel to the United States and the Caribbean, but refinery shutdowns have become so common that they rarely affect market prices.
Traders told Reuters the docks at the refinery were shut, and tankers were anchored offshore waiting. They said this would cause delays to some of the country's exports.
The explosion broke windows at homes in the area, a peninsula in the Caribbean sea in western Venezuela, as well as at Amuay's main administrative building.
The blast was also felt out at sea in the Paraguana bay, where some crew members on moored tankers were knocked off their feet by the shockwave, one shipping source said.
Ramirez said the fire that started after the explosion had only affected nine storage tanks holding mostly crude oil and some processed fuels including naphtha.
Officials said two tanks were still burning off residual fuel, and a Reuters witness at the scene said large black clouds of smoke still hung above the area.
Ramirez said existing fuel stocks around the country were sufficient to guarantee 10 days of exports and local sales. PDVSA has no plans to invoke force majeure, he said, which lets companies stop shipments due to accidents or extreme weather.
Amuay, together with a neighboring facility, forms part of the Paraguana Refining Center, the second-biggest refinery complex in the world, with an overall capacity of 955,000 bpd.
In 2010, there was a massive fire at a PDVSA fuel terminal on the Caribbean island of Bonaire, then a blaze at a dock at the Paraguana complex that halted shipping for four days.

Got broadband? Access now extends to 94 percent of Americans.

Every year, Internet access via broadband becomes available to millions more Americans, up from 92 percent last year to 94 percent, a recent report shows. Rural and tribal areas are the outliers.

Access to the Internet via broadband has now spread to 94 percent of Americans, a jump of two percentage points over last year and a huge leap from the 15 percent who had such access just a decade ago.

The steady expansion of the broadband Internet infrastructure has come about as a result of both government backing and private investment, according to the Broadband Progress Report by the Federal Communications Commission (FCC) released Aug. 21. Broadband encompasses various technologies ? cable, DSL, fiber optic cables ? that allow people to connect to the Internet at higher speeds and download data at faster rates.

The FCC annual report commended private-sector companies for continuing to expand into ever-more remote areas, even during the recent years when the economy has struggled.?

Of course, that still leaves 6 percent of the populace ? some 19 million people ? without a way to order from amazon.com, share photos on Facebook, or learn about job opportunities in far-away places.?

Access to the Internet is essential in today's increasingly networked economy and culture, says Lee Rainie, director of the Pew Internet and American Life Project, an independent research organization that has tracked the social impact of the Internet for the past 12 years.??

?People use the Internet to access alternative business options and to become more informed consumers,? says Mr. Rainie, author of ?Networked: The New Social Operating System.???People get high-quality health information so they can take care of themselves in better and smarter ways.?

The 19 million who have no broadband access includes one-fourth of people living in rural counties and one-third of people living on tribal lands, areas where infrastructure is often nonexistent. That's 7 million fewer than last year.?

Closing the ?last mile? of connectivity ? the end of the line where the Internet is physically impossible to access due to lack of infrastructure ? is expensive, and there is little financial incentive for telecommunication companies to do it.?

But the 1996 Telecommunications Act requires that the federal government deploy advanced telecommunication capabilities to ?all Americans in a reasonable and timely fashion.? The FCC report, for the past three years, has determined that the rate of connecting Americans to the Internet has not been fast enough.

"This year?s Report reflects the huge strides that both the private and public sector have made to extend broadband, while also explaining that there?s more work to do,? said FCC Chairman Julius Genachowski, in a statement. "Increasing broadband deployment, increasing adoption, increasing speeds and capacity are vital throughout our country; they?re essential to growing our innovation economy and driving our global competitiveness."

Two of the five commissioners disagree with the report's assessment, saying that it understates the growth.

?In reality, the growth of broadband deployment in America, especially regarding the mobile marketplace, has been swift and strong,? said Commissioner Robert McDowell, in his statement. Back in 2003, he said, only 15 percent of Americans could access broadband Internet.?

Not only do more Americans than ever have access to broadband services, but more are actually taking advantage of it by subscribing to a service in the home. Sixty-four percent of those with access opted to pay for a service in 2011, compared with 62 percent in 2010, the FCC report found.?

Broadband subscriptions have increased steadily over the past decade, according to data from the International Telecommunications Union, from 7 million in 2000 to 90 million in 2011 in the US. The Pew Internet project research also finds that household adoption rates in the US have increased during the past several years, although it notes that barriers remain such as affordability or simply the perception that Internet access isn't necessary.

Gaps in adoption rates are most notable among income levels, education, and race, with 70 percent of whites subscribing to broadband in the home compared with 54 percent of blacks and 51 percent of Hispanics, according to Pew Internet data.?

With the advances in mobile and wireless technology, Rainie says that being connected to the Internet has become the norm for most Americans.??People aren?t differentiating between what is virtual life and real life,? he says. ?Connectivity is embedded into life, its rhythms, and people?s expectations.?
